Microsoft and OpenAI Just Got Hit with Another Copyright Lawsuit
Microsoft and OpenAI have another copyright lawsuit to deal with. Yes, you read that correct. Emmerich Newspapers and five other publishers have filed a fresh copyright complaint in Mississippi. This isn’t the first time Microsoft and OpenAI has been sued by publishers. Earlier this year, Microsoft and OpenAI were sued by 400 newspaper owners. That’s not all; you must be aware of the copyright lawsuit filed by The New York Times against OpenAI and Microsoft, though the court has not reached a final verdict or ruling yet.
Publishers want Microsoft and OpenAI to remove their work
The lawsuit was filed on October 2 in the U.S. District Court for the Southern District of Mississippi. Emmerich Newspapers, Ojai Media, and four Coopwood companies are named as plaintiffs.
The publishers accuse Microsoft and ten OpenAI entities of copying their articles while building and training GPT models. The complaint also alleges that copyright management information was removed from those works.
According to the complaint, the allegedly removed information includes author credits, publication names, copyright notices, and terms of use information. The publishers argue that their articles appeared in datasets used for AI training. Publishers want an injunction requiring the defendants to remove copies of their registered works from GPT and other LLM models and training sets.
This could become another major AI copyright test
The complaint names Microsoft Corporation alongside ten OpenAI entities. It includes claims involving copyright infringement and copyright management information under the DMCA. Now that Emmerich is taking its copyright fight directly to companies building major AI systems, it will be interesting to see what happens in this case.
For now, allegations made by Emmerich Newspapers and five other publishers is contained in the publishers’ complaint. The court has not ruled on the claims, with no reported response from Microsoft or OpenAI.
